Hungary has convicted an Iraqi migrant on charges of illegally entering the country, the BBC reports. This is the first such conviction since the government declared a state of emergency yesterday (Tuesday).

The convicted man is named Ahmed Suadi Talib. He is originally from Iraq but was studying in Syria. He testified that he and his brother fled ISIS and crossed into Hungary through a hole in the fence.

The crime carries a sentence of up to three years in prison.
